Illegal Child

Question:

Please send me information on the basis of Quran and Hadith about illegal child in Islam, wether he can be a useful member of society or not. Please send me quickly. Thanks

Answer:

Dear brother, Assalamualaikum Wa Rehmatullah

The illegal child is an innocent body and in no way a sinner, he must be treated with equal respect in the society, however the parents are responsible for this grave major sin. If both of the parents were non-Muslims earlier, and the society accepted the out of marriage children as legal then after Islam those children shall be treated as legal. But if the parents are Muslims living in an Islamic country, they shall be punished by an Islamic court after the court makes proper arrangements of care and guardianship of the child. The prophet Muhammad (PBUH) is reported to have said that such a child shall be attributed to the mother (as undoubtedly she is the mother, but this cannot be said about the father) surely.
